Per 39-28.8-501(6), C.R.S., "To increase transparency, the marijuana enforcement division shall include a link on its website that describes the disposition of the retail marijuana excise tax revenue and how the revenue from the fund was appropriated for the fiscal year 2015-16 and each fiscal year thereafter."
Disposition of Retail Marijuana Excise Tax
A history of the monthly revenue disposition of retail marijuana excise tax since 2014 is available on the Marijuana Tax Reports web page. The bullets below describe the statutory requirements on the disposition of retail marijuana excise tax per fiscal year (FY).
- For FY 2023-2024, all of the retail marijuana excise tax received shall be transferred to the Public School Capital Construction Assistance Fund.
- For FY 2022-2023, all of the retail marijuana excise tax received shall be transferred to the Public School Capital Construction Assistance Fund.
- For FY 2021-2022, pursuant to HB20-1418, all of the retail marijuana excise tax received was transferred to the Public School Capital Construction Assistance Fund.
- For FY 2020-2021, pursuant to HB20-1418, the first $40 million of the retail marijuana excise tax received was transferred to the Public School Capital Construction Assistance Fund and any remaining money was transferred to the Public School Fund.
- For FY 2019-2020, pursuant to HB19-1055, all of the retail marijuana excise tax received was transferred to the Public School Capital Construction Assistance Fund.
- For FY 2018-2019, pursuant to HB18-1070, the greater of $40 million or 90 percent of excise tax received was credited to the Public School Capital Construction Assistance Fund. Any excess tax collections were transferred to the Public School Fund.
- For FY 2017-2018, the first $40 million of the retail marijuana excise tax received was distributed to the Public School Capital Construction Assistance Fund. Excise tax collections in excess of $40 million were transferred to the Public School Fund.
- For FY 2016-2017, the first $40 million of the retail marijuana excise tax received was distributed to the Public School Capital Construction Assistance Fund. Excise tax collections in excess of $40 million were transferred to the Public School Fund.
- For FY 2015-2016, the first $40 million of the retail marijuana excise tax received was distributed to the Public School Capital Construction Assistance Fund. Excise tax collections in excess of $40 million were transferred to the Public School Fund.
